General rental terms and conditions

These general rental terms and conditions apply to all offers, reservations, and rental agreements relating to the holiday home(s) offered by the landlord in Spain, as well as to the stay within the apartment complex and the use of the associated facilities.

1. Parties

Landlord: W.J. de Graaf, residing at Noorderlaan 5, 5102 BA Dongen, The Netherlands.

Tenant (main booker): the natural person aged 21 years or older who makes the reservation, also on behalf of all accompanying guests.

Guests are understood to be all persons staying in the rented property with the permission of the tenant and the landlord.

2. Applicability

These terms and conditions apply to the exclusion of any other general terms and conditions.

In addition, the applicable house rules, community rules, and regulations of the apartment complex (Homeowners’ Association / Comunidad de Propietarios) in which the property is located apply.

The tenant declares to have taken note of these rules and agrees to strictly comply with them.

3. Nature of the agreement

The agreement concerns the temporary rental of residential accommodation for recreational use (holiday rental) and does not fall under statutory tenant protection.

Permanent residence is expressly prohibited.

4. The rented property

The rented property is a fully furnished holiday home located at Calle Praga 1, Apartment 52, 30739, San Javier, Murcia, Spain, including inventory and shared facilities.

5. Reservation and conclusion of the agreement

Reservations are accepted exclusively from persons aged 21 years or older.

The agreement is concluded at the moment the landlord confirms the reservation in writing or by email.

After confirmation, no right of withdrawal applies.

6. Rental period, arrival and departure

The rental period, check-in and check-out times are stated in the reservation confirmation.

Late arrival or early departure does not entitle the tenant to any refund.

7. Number of persons

The maximum permitted number of guests is 6.

Exceeding this number is not permitted and may result in immediate termination of the stay without refund.

8. Rental price and additional costs

The rental price and any additional costs, such as cleaning fees, deposit, and tourist tax, are stated in the reservation confirmation.

All prices include VAT, unless explicitly stated otherwise.

9. Payment

  • Deposit: 50% within 14 days after reservation.
  • Remaining balance: no later than 14 days before arrival.
  • Last minute: Last minute bookings, within 14 days of arrival, pay the full amount at the time of booking.

If payment is not made on time, the landlord is entitled to cancel the reservation.

10. Security deposit

The tenant shall provide a security deposit, the amount of which is determined at the time of booking based on the length of the stay and the number of guests. The security deposit may be paid in advance prior to arrival or provided by means of a temporary reservation (pre-authorization) on a valid credit card.

The landlord is entitled, after departure, to collect or offset any justified claims against the security deposit or the credit card authorization.

Any remaining balance of the security deposit will be refunded within a reasonable period after departure, after settlement of any outstanding costs.

11. Cancellation

Cancellation must be made in writing or by email.

  • More than 3 months before arrival: 15%
  • 3 to 2 months before arrival: 50%
  • 2 to 1 month before arrival: 75%
  • 1 month to 1 day before arrival: 90%
  • On the day of arrival or no-show: 100%

12. Conduct, community rules and nuisance

The tenant and guests must behave as responsible users and avoid any form of nuisance.

Compliance with all community rules of the apartment complex is mandatory, including but not limited to:

  • quiet hours and noise regulations;
  • use of shared areas;
  • waste disposal;
  • parking regulations;
  • use of swimming pools and other facilities.

Violation of these rules may result in immediate termination of the stay without refund.

13. Pets

Pets are not permitted unless expressly agreed in writing and permitted by the apartment complex.

14. Subletting

Subletting or making the property available to third parties is not permitted.

15. Liability

The tenant is liable for damage to the rented property, inventory, and common areas.

The landlord is not liable for damage caused by force majeure, utility failures, weather conditions, or actions of third parties.

16. Force majeure

In the event of force majeure, the landlord is entitled to amend or terminate the agreement without any obligation to pay compensation.

17. Termination

In the event of non-compliance with obligations, the landlord is entitled to terminate the agreement with immediate effect.

18. Invalidity

If any provision is null or void or becomes voidable, the remaining provisions shall remain fully effective.

19. Applicable law and competent court

This agreement is governed exclusively by Spanish law.

Any disputes shall be submitted to the competent court in the district where the rented property is located, unless mandatory law provides otherwise.

20. Final provision

By making a reservation, the tenant declares to have read and agreed to these general rental terms and conditions.
